In every moral and ethical sense, yes. In a technical legal sense, probably (in that this would seem to be a violation of at least a couple oaths).

But in a practical sense, of course not. The only body capable of holding him accountable is Texas voters.

This whole trial was never legal in the first place. You cannot just change the constitution because you "feel" like it. This also sets up Harris for a real problem by 2022 or later. She bailed out criminals for extra votes and could be on trial for that eventually. Be careful what can of worms you open.

Please share with us what wasn't legal about the trail.
What in the Constitution was changed?
What problem/s is/are Harris going to have?
I assume you realize NANCY (and the house) are 2-0 against Trump. Actually 3-0 if you count the 2020 election.

no senate

no presidency

loosers of a feather flock together

(oh, and there is zero in the constitution that would make this impeachment illegal or unconstitutional - impeachment occurred while the dips hit was in office. nothing in the constitution says the senate trial has to happen while in office also)

I wish Dems would have subpoenaed everyone about everything. If anybody says anything about drawing it out, just reply, “but Benghazi!!”

Get any senator who had any contact prior. Get those ones who were giving magaheads tours the day before. Get Mitch up there and ask if he didn’t think it’s appropriate to try a potus after he’s left office then why didn’t he allow the trial to start while he was still in office. Put the entire trumpublican party on trial.

There was nothing at all illegal or untoward about the trial. It would make zero sense for the law to be that a president impeached while in office can only be tried while in office. That necessarily invites the exact sort of conduct that the law is intended to prevent.

I wonder how any impeachment proceedings would have been handled if, say, Obama was accused of inciting a riot that left 5 dead and more injured and millions of dollars of damage to the Capitol....

Or heck, if Obama was caught asking a foreign leader to interfere in our elections?

It's just out-and-out bad faith. And it probably justifies the Democrats killing the filibuster (which, long story short, means that you really need 60 yes votes to pass most legislation). Why should the Democrats even pretend that their policy proposals will be met with good faith and earnestness?
